Terms of Service#

1. Acceptance of Terms#

By accessing or using the Cranny website (the-cranny.com) or the Cranny mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Daniel Jancar, trading as "Cranny" ("Cranny", "we", "us", "our"). You may contact us at [email protected].

2. Eligibility#

You must be at least 16 years old to use the Service. During registration, you are required to confirm that you meet this age requirement. If you become aware that a person under 16 is using the Service, please notify us at [email protected].

3. The Service#

Cranny is a platform that allows users to discover, share, and save location-based spots ("Spots") — such as viewpoints, outdoor areas, urban locations, and other places of interest. All Spots are entirely user-generated. We do not create, inspect, verify, or endorse any Spot or the information associated with it.

4. Account Registration#

To submit Spots, upload images, or access certain features, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activity conducted through your account

5. User Content#

5.1 Licence to Cranny#

By submitting any content to the Service — including Spot descriptions, GPS coordinates, tags, images, and profile information (collectively, "User Content") — you grant Cranny a non-exclusive, worldwide, royalty-free, sublicensable, perpetual licence to use, reproduce, display, distribute, adapt, and create derivative works from that content for the purposes of:

  • Operating and improving the Service
  • Featuring your content on our website and within the app
  • Sharing, reposting, and promoting your content on our social media channels (including Instagram and TikTok)
  • Using your content in advertising, marketing campaigns, press materials, and other promotional content, in any media format now known or later developed

You retain full ownership of your User Content. This licence does not allow us to sell your content to third parties. If you delete your account or remove specific content, this licence ends for future use of that content; however, content that has already been published or incorporated into promotional materials may continue to be used.

If you do not want your public content used for promotional purposes, contact us at [email protected] and we will exclude your content from future promotional use.

5.2 Your warranties#

By submitting User Content, you confirm that:

  • You own or hold all necessary rights and permissions to submit the content
  • The content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights
  • Where the content includes images of identifiable persons, you have a lawful basis to share those images, and you take full responsibility for any privacy implications thereof

5.3 Content removal#

We reserve the right to remove any User Content that violates these Terms, our Community Guidelines, or that we determine, in our sole discretion, to be harmful, inaccurate, unlawful, or otherwise inappropriate, without notice and without liability to you.

6. Community Guidelines#

Your use of the Service is also governed by our Community Guidelines, which are incorporated into these Terms by reference. Violation of the Community Guidelines may result in content removal or account termination.

7. Spot Information — No Verification, No Warranty#

All Spots on Cranny are created and submitted by users. We do not verify, inspect, or endorse any Spot. We make no representations or warranties — express or implied — regarding:

  • The accuracy of any coordinates, descriptions, categories, or tags
  • Whether a Spot is safe, accessible, or suitable for any purpose
  • Whether a Spot is located on public land or whether access is legally permitted
  • The current condition, existence, or availability of any Spot
  • Whether visiting a Spot complies with any applicable law or regulation

Spot information may be incomplete, incorrect, outdated, or misleading. You rely on Spot information entirely at your own risk.

8. Physical Risk and Assumption of Risk#

VISITING ANY SPOT INVOLVES REAL PHYSICAL RISK. BY USING THE SERVICE TO DISCOVER OR PLAN A VISIT TO ANY SPOT, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THAT VISIT, INCLUDING THE RISK OF SERIOUS INJURY OR DEATH.

Without limiting the foregoing, Cranny expressly disclaims all liability for:

  • Any accident, injury, illness, or death that occurs during or as a result of visiting a Spot found through the Service
  • Any damage to your property, vehicle, or equipment sustained during a visit
  • Any emergency, rescue, or medical costs you incur in connection with a visit
  • Any weather-related, environmental, structural, or other hazard you encounter at any Spot
  • Any civil or criminal liability arising from your decision to visit any location

You release Cranny from all claims related to any injury, death, loss, or damage arising from your use of the Service or your visit to any Spot.

9. Trespass and Property Rights#

Cranny does not verify whether any Spot is located on public land, private property, restricted areas, military zones, or other locations where access may be prohibited or require permission.

You are solely responsible for determining whether you have the legal right to enter any location before visiting. We are not responsible for any trespass, civil or criminal liability, fines, penalties, legal proceedings, injury, or loss that arises from your decision to enter any property.

10. Prohibited Conduct#

You agree not to:

  • Submit false, misleading, dangerous, or unlawful content
  • Submit Spots that you know to be on private property where access is not permitted, without clearly disclosing that fact
  • Upload images you do not have the right to share, including images of identifiable persons without a lawful basis for doing so
  • Harass, threaten, defame, or harm other users
  • Attempt to access, reverse-engineer, decompile, or compromise the Service or its infrastructure
  • Use automated tools, bots, or scripts to scrape, crawl, or spam the Service
  • Create multiple accounts to circumvent bans or access restrictions
  • Use the Service for any commercial purpose without our prior written consent
  • Violate any applicable local, national, or international law or regulation

11. Intellectual Property#

The Cranny name, logo, design, and all original content created by us remain the intellectual property of Cranny. Nothing in these Terms transfers any intellectual property rights to you. User Content remains owned by the respective users, subject to the licence in section 5.1.

We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please review our Copyright Takedown Policy and submit a notice to [email protected].

13. Termination#

We may suspend or permanently terminate your account at any time, with or without notice and without liability, if we determine that you have violated these Terms or that your use of the Service is harmful to others or to us.

You may delete your account at any time in one of two ways:

  • In the app: Go to Settings → Account → Delete Account. Your account will be immediately deactivated and will no longer be accessible to you or other users. After a 10-day period, your account and all associated data — including your profile, spots, images, and bookmarks — will be permanently and irreversibly deleted.
  • By email: Send a deletion request to [email protected]. We will process your request and confirm once deletion is complete.

During the 10-day deactivation period, your account cannot be accessed and your content will not be visible to others. If you change your mind, you can cancel the deletion by signing back in to your account or by contacting us at [email protected] before the 10 days have elapsed. After 10 days, deletion is permanent and cannot be undone.

14. Disclaimer of Warranties#

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability#

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) CRANNY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE OR YOUR VISIT TO ANY SPOT.

(b) OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED CHF 100 (ONE HUNDRED SWISS FRANCS).

Note: Under Swiss law (Art. 100 of the Swiss Code of Obligations), liability for death or personal injury caused by gross negligence or intentional misconduct cannot be contractually excluded. Nothing in these Terms is intended to limit liability to the extent that such limitation is not permitted under applicable law.

16. Indemnification#

You agree to indemnify, defend, and hold harmless Cranny from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your visit to any Spot; (d) your violation of these Terms; or (e) your violation of any applicable law or the rights of any third party.

17. Governing Law and Jurisdiction#

These Terms are governed by Swiss law, excluding its conflict-of-law provisions. Any dispute arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Switzerland. This choice of jurisdiction does not affect any mandatory rights you may have under the law of your habitual residence, including the right to bring proceedings in the courts of that jurisdiction.

18. Severability#

If any provision of these Terms is found by a court to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Changes to These Terms#

We may update these Terms at any time. The "last updated" date at the top of this page reflects the most recent version. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. For material changes, we will endeavour to notify registered users by email.
